Re: Florida Concealed Weapon/Firearm Licenses

ANSWERS TO COMMONLY ASKED QUESTIONS ABOUT RECIPROCITY AND TRAVELING WITH A FIREARM

QUESTION 9. I am a Florida license holder, and I have recently received a solicitation in the mail for an "official badge" identifying me as such a license holder. Are these badges legal? Does the Division endorse these badges?

No, the Division does not endorse these badges, but they are not illegal. There is nothing in Florida law that specifically prohibits companies from offering to sell these badges to Florida license holders, nor is there any provision that prohibits license holders from carrying such badges.

License holders should be aware that the use of official badges is prohibited in Florida Statutes in a couple of places. Section 30.46 specifies that a badge in the shape of a five-pointed star can be used by Florida sheriffs and deputy sheriffs only. Section 843.085 makes it unlawful to wear or display any authorized indicia of authority (including any badge) which could deceive a reasonable person into believing that such item is authorized by any federal, state, county, or municipal law enforcement agency.

Licensees should also take note that these badges do not substitute for identification or confirmation of your status as a holder of a Florida Concealed Weapon or Firearm License. Only the license issued by the Division will serve as a means of identifying a citizen as a license holder.
Your right DeltaWolf , that does deserve to be repeated! Wow bfips , that's the answer I've been looking for. I didn't even think of looking there. Dummy me. Thanks , and with an answer like that I'll consider this thread

"2. You can be considered as "impersonating an officer" if you display it while walking around, etc."

I dont agree with you. State of florida has certain symbols forbidden from use in badges (Seal of florida + 5 pointed star being 2 of them). Simply having a decorative badge with your CCW # on it does not imply your impersonating an officer.

On a side note, CCW badges are extremely mall-ninja-ish and should be avoided at all cost, being that they are a totally useless accessory.

"Baches? We don't need no stinkin' baches!"

Not a good idea... unless you're the guy sellin' 'em. Then they're a fine idea and EVERYBODY should have one.

Badges are OK, as long as you're willing to wear this shirt at the sametime.

They are very valuable in identifying a wannabe cop or someone who wants to be thought a cop. On an equal standing with a Mall Ninja.

unlawful to wear or display any authorized indicia of authority (including any badge) which could deceive a reasonable person into believing that such item is authorized by any federal, state, county, or municipal law enforcement agency.
When I first thought of carrying I also thought maybe it would be a good idea to have a small concealed badge next to my concealed gun in case of accidental exposure
I had no wannabe reasoning, I get so tired of that retort every time this question comes up
But if you look at the statute wouldn't the reasoning behind having the badge in that fashion be for the purpose of deceiving the ordinary reasonable person into thinking that you are authorized by a police agency to carry the gun?
Or at the very least couldn't an anti DA twist it that way ?

I see by Lowell's link that they have come down in price a little

I may actually get one now
For the reasons I stated earlier, not for any type of public carry
But I also want a Brothel Inspector badge

I know a few "gun shop" cops who have one and I think that alone is enough reason to not have one.

Anyone that's ever dealt with a LEO that did NOT like the fact that you carry a gun would also see the obvious benifits of not having the badge.

Remember, not all LEO think citizens should be armed and "doing their job" by protecting yourself.
