Quick question

Post by D_GUNNER » Fri Feb 19, 2016 8:12 am

Did they ever change the law of concealed carry. The part if you show just briefly by accident, a chance of being arrested.
(Yes I know the open carry failed to pass.)

Yes. I just verified it the other day. So if you accidentally flash, it is not illegal.

when I wear a shoulder holster, i can leave the cover shirt unbuttoned all the time if I want.

Ehh...not sure about that. You can't display it. You can "flash it accidentally", but you can't leave it on display where someone can easily see it.

Here's how the statute currently reads:
790.053 Open carrying of weapons.—
(1) Except as otherwise provided by law and in subsection (2), it is unlawful for any person to openly carry on or about his or her person any firearm or electric weapon or device. It is not a violation of this section for a person licensed to carry a concealed firearm as provided in s. 790.06(1), and who is lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense.

HB 163, the Open Carry bill that's now dead, would have eliminated the "briefly and openly display" language, replacing it with the ability of CWL holders to carry openly. For now, the law remains as quoted above.

" It is not a violation ... to briefly and openly display the firearm to the ordinary sight of another person, "

That is the way I read it. Intentional (but non threatening) is OK.

No, I don't want to be a test case in court, but I could read this as it is fine and dandy to show yer buddy your carry piece, while sitting in the diner.

I was more aware of my carry method (shoulder holster) the other day, where 3 deputies were seated a few yards away, as I walked in for lunch. Turned out to be a non-issue. Nobody appeared to see it. Florida is a great state!
