Orlando Gun Show,60 days in Jail for Private Sale?

Post by Jim » Sat May 19, 2018 6:28 pm

I saw on Channel 9 Orlando that City of Orlando passed a 3 day waiting period and all private gun sales at the Gun Show had to go thru a background check. Orlando Police were to patrol the show and if you go caught doing a private sale without a background check you could get 60 days in Jail. :ham'r

I quit gun shows a long time ago. Overpriced, bull sh$@ artists trying to con people. Private sales will probably be illegal overall in a couple of years even though background checks would not, or did not stop mass shootings.

Pictures of guns on the table, get a purchase ticket and go off the property to an armed guy in an RV to complete the sale.

Of course, then the Feds would get involved...because someone going that out of the way should have a FFL.

As we all know the only reason for this is to make gun shows too much trouble to buy firearms at, next will be firearm's parts then ammo then hand loading stuff until there is no one selling and attending.
I'm not at all surprised. Jerky, books and militaria will be all that's left.
There is no other logic in this. But if I already have a few firearms what does the "3 day cooling off" period do?

Not sure how they legally could do that. The state law says no city/county can pass it's own gun legislation more stringent then current state law I believe?

Theres a loophole for counties to mandate background checks.

Utterly useless and has zero effect on crime.

Is this just within the gunshow premises or city of Orlando in it's entirety?

Also, if the buyer has a FL CWP, the 3 day waiting period is waved - just as it is when purchasing from a dealer.
This is a Gun Show only rule - as most politicians call this the "Gun Show" loophole. As far as I'm aware, this doesn't affect private gun sales - just the ones made at a Gun Show location.

Here's the full text of the new ordinance:

https://library.municode.com/fl/orange_ ... eId=890817

No sales on any publicly accessible piece of property, meaning no more Wal-mart or police station parking lot sales either.

Thanks for that link....so, if I read this correctly - in Orange Co - you would now have to do a private sale at one's home or travel out of county?

Yep.

Legalese is easy to read, but people just don't want to believe what's written in clear and plain language.

Doesn't mean this ordinance is going to stand up to legal challenges, but people are going to take the arrows in the ass in the meantime.

My take is yes a private seller can waive the 3 day wait with a CWL but not the
background check at a gun show or other public place?

Correct.

I wonder if someone will start a private gun trading club.

And that's only if someone's actually challenges it.

Yep.

They have passed several of these local ordinance's in Fort Lauderdale. All of them are found not valid. If you ask at the show they tell you absolutely no private sales. But they check in all weapons and you get to walk around and try to sell them. One time I bought a 3 screw Ruger Single six at the War Memorial Show. The guy did not have an FFL. We walked over to Trader Rich and he did the NICS and transfer.

But the difference is the War Memorial in Ft Lauderdale where the show takes place is owned by the city of Ft. Lauderdale. Their building, their rules. GARY.

Same in Miami. If the government is acting as landlord, they have more discretion. Even our commies down here have not (yet) tried to bar private sales in all public places.
