To all the nim-nods (mostly on FB) who claim that shooting a car burglar is permissable & legal, here is your poster boy:


Fort Lauderdale Man Charged With Trying To Kill Car Burglar

A Fort Lauderdale man who told police he was trying to stop a car burglar by shooting him is now charged with trying to kill him. A $15,000 bond has been set for James Tenney.

In the darkness before dawn, a Fort Lauderdale man opened fire on two juveniles inside his SUV -- and now he is charged with trying to kill one of the teenage suspects.

James Tenney, 35, told police that early on Dec. 12 he shot at the pair in his 2017 GMC Yukon, which was parked outside his townhouse on the 600 block of Southwest Sixth Street, according to a police report.

The 16-year-old boy who was shot had injuries that were not life-threatening, police said.

The two juveniles admitted to police they had been out burglarizing vehicles, said Tenney’s attorney, Robert Davis.

They were on their “seventh or eighth burglary of the evening. They were on a roll,” Davis said.

Following an investigation, Tenney was arrested Thursday on a charge of attempted manslaughter.

During a court hearing Friday morning, Davis sought to have Broward Judge Kim Theresa Mollica set a minimal bond for his client.

“He obviously did not go looking for trouble,” Robert Davis said, “it came to his house.”

Tenney initially told police he saw two people inside his vehicle and when he opened his home’s front door, one of the two charged at him, according to the arrest report.

However, neighborhood surveillance video shows Tenney firing twice at two people as they were running away, the report said. Additionally, investigators said he followed the two into an intersection — 184 feet from his residence — and fired two more times.

Tenney “went into the street and continued firing at the two individuals” even as they ran “and posed no imminent threat,” said Assistant State Attorney Eric Linder, who was seeking a bond of $50,000 for Tenney.

Mollica set Tenney’s bond at $15,000 and ordered him not to possess any firearms or ammunition while his case is pending.

Arrows might still show up on surveillance videos, though.

Looking at his criminal history, I'm surprised he's allowed to own a gun.

It's yahoos like this who will get SYG repealed.

Here's the other thing. Don't talk to the police until you talk to an attorney. Gutmacher (sp?) tells us to say something like, "Even when a police officer shoots a man the police union tells them not to talk about it until the union rep and an attorney talks to you first. I am going to do the same thing and wait to talk to my attorney."

If this guy had waited for his attorney I bet he wouldn't have concocted an easily disprovable lie. Better no story than a lie.

I can clearly see the double standard when a police officer does a run-n-gun...the exact same logic applies there as with this example.

Can't keep shooting after the threat is done.

Now that he gave a statement that is untrue (assuming, I haven't seen the footage), it's going to be hard for his attorney to show that he was not retaliating, but still defending.

In the box, a lawyer telling me that the only thing I need to decide is at the moment he fired shots 4, 5, and 6, is it possible that his client was defending himself- we have evidence of car vandalism by the victim and video of what could have appeared to be an item in his hands pointed at my client.

It sounds much better than my client stated he was being attacked, he wasn't being attacked, but...
