Question for SOT/Manufacturers

Ok, having a debate with a friend of mine...my understanding is that an SOT manufacturer can build machineguns pretty much whenever they want (post sample obviously), but they cannot transfer them to anyone other then Police, Military, or other NFA dealers with a LEO letter. My friend says that a SOT needs a letter from a law enforcement agency to even MAKE a dealer sample...whos right? :-k

You are correct: 07/02 FFL/SOT manufacturers do NOT need a demo letter before commencing manufacturing.

It would be pretty silly, because there would be no way to create inventory for future sales. Imagine if Colt had to get a demo letter in advance, before building each M4 that was going to law enforcement!

Matt, some further explanation:

An individual files a Form 1 and it must be approved prior to making an NFA item.

An 07/02 FFL/SOT manufacturer files a Form 2, only after he has completed manufacturing an NFA item. In fact, it would be felony perjury for an 07/02 to file anything in advance with ATF; the Form 2 is swearing that he has completed manufacture of an NFA item.

So really, there would be no legal reason or route for an 07/02 to make use of an LE demo letter for his own production items.

Now, LE demo letters are required for approval of a Form 3 transfer of an existing, registered machine gun. So if an 07/02 wants to purchase an MG which someone else has made and registered, then yes, he must submit an LE demo letter with the Form 3, the same as an 01/03 FFL/SOT dealer must.

But an 07/02 manufacturer does not need any letter to manufacture any class of NFA.

I prefer to think of it as an 07/02 files a "Hey Mom, look what I did!" versus everyone else filing a "Mother may I?".
