Form 1 for AOW questions

Post by George W » Sat Aug 18, 2012 1:24 pm

Let me see if I have this correct.......
If I buy a new (in my case Rem 870) shotgun that came factory with a PG and has never had a stock on it, I came make it an AOW on a Form 1 for a $5 stamp, correct?

Now, let's say one day I decide I want to put a stock on now said AOW...... Is it still an AOW? Or, have I just created an illegal SBS?

no. for an individual to make any NFA gun on a Form 1 is a $200 tax, even for an AOW. That's why it would be in your best interest to find a friendly SOT Manufacturer <cough> who will "make" and engrave the gun for you for less than $195 and then transfer to you on a Form 4. An AOW of that type can not posses a buttstock and if you were to do it that would be illegal because it then meets the definition of an SBS.

Call me later today if you want a few ideas.

Okay for a $200 tax stamp I can do it myself on a form 1 as either a SBS or an AOW, correct?

If done as an SBS, I can add a stock or take off the stock, vertical grip, whatever, right?

What would be the advantage of having a shotgun done as an AOW other than lower cost to someone should I sell it?

correct and correct.
The primary advantage on AOW is the $5 transfer when you sell it. A secondary advantage would be for certain states (Michigan for example) where AOWs are legal but SBS are not.

Another approach is to buy the pistol-gripped shotgun and take it to any 07/02 FFL/SOT manufacturer. They can chop the barrel and register it as an AOW tax-free, then transfer it to you on the $5 transfer. So all you pay for is the shotgun itself, the work chopping the barrel, and the $5 tax.

I think that was the approach Scott was suggesting.

If you have him build it for you, make sure you tell him he cannot use it for a demo at the gunshow. If it IS at the show, I will make sure HUNDREDS of people rub their dick skin on it. Then there will be talk of using it as a throw down for a 7-11 heist.
